Full Ski Season Rental Agreement
Standard terms for season residences, 15 December to 15 April. Version 1.0, August 2026.
1. Parties, Residence and Term
This Season Rental Agreement (the "Agreement") is entered into between Altimera Collection ("Altimera", "we", "us") and the person named in the signature block (the "Guest"), who takes the residence identified there (the "Residence") in the New Gudauri Ski Resort, Georgia.
The term runs from 15 December to 15 April (the "Season"), being 121 nights, unless different dates are recorded in the signature block. Check-in is from 15:00 on the first day and check-out is by 11:00 on the last.
This is a licence to occupy furnished holiday accommodation for the Season. It does not create a tenancy, lease or any security of tenure, and it does not entitle the Guest to register the Residence as a permanent address or place of business without our prior written consent.
2. Charges, Deposit and Payment
The season charge is the single all-inclusive amount recorded in the signature block, in US dollars. It covers the Residence for the Season, utilities as described below, the housekeeping schedule described below, Wi-Fi, bed linen and towels, and a locker in the ski depot.
A deposit of 30% of the season charge is payable to confirm the booking. This deposit is NON-REFUNDABLE in all circumstances, because acceptance of it withdraws the Residence from sale for the entire Season. The balance is payable in cleared funds by 1 December, or immediately if the booking is made after that date. The Residence is not held until the confirming deposit is received.
A refundable security deposit of US$1,000 (the "Security Deposit") is payable before arrival and is held for the Season. It is not rent and may not be applied by the Guest against any payment due.
The Security Deposit is returned within 14 days of check-out, less any amounts properly deducted under this Agreement. Where the cost of loss or damage exceeds the Security Deposit, the Guest remains liable for the excess and it is payable within 14 days of our written demand.
Late payment of any sum due carries interest at 1.5% per month on the outstanding balance. If the balance is more than 14 days overdue we may treat the booking as cancelled and retain the confirming deposit.
3. Cancellation and Early Departure
Cancellation more than 60 days before the start of the Season: the 30% confirming deposit is retained in full, as stated above, and no further sum is due.
Cancellation 60 days or fewer before the start of the Season, or at any point during it: the full season charge remains payable. We will use reasonable efforts to re-let the Residence for the unexpired period and will credit any sums actually recovered, less costs of re-letting.
Early departure does not entitle the Guest to any refund. The Residence remains available to the Guest for the balance of the Season.
We may terminate this Agreement immediately, without refund, for any material breach, including the House Standards, the occupancy limits, the prohibition on subletting, or non-payment.
4. Occupancy and Guest Information
The Residence may be occupied only by the individuals named in the signature block, up to the maximum stated for that Residence. First and second floor residences take a maximum of 3 adults, or 2 adults and 2 children. Fourth floor residences take a maximum of 4 adults, or 3 adults and 2 children. Children are persons under 16 years of age.
Before arrival the Guest must provide, for every occupant: full name as it appears on their travel document, date of birth, nationality, passport or national identity card number with a legible copy, and emergency contact details. Georgian law requires accommodation providers to hold and, where required, report guest identity information, and we cannot permit occupancy without it.
The Guest must notify us in writing before any change to the named occupants. Unnamed persons may not occupy the Residence overnight without our prior written consent, which will not be unreasonably withheld for genuine short visits.
Visitors are permitted during the day at the Guest's responsibility. Overnight guests beyond the named occupants require our written consent and may be subject to a charge. Undeclared overnight occupancy is a material breach and carries a charge of US$150 per person per night, in addition to any other remedy.
5. Subletting and Assignment, Absolutely Prohibited
The Guest may not sublet, assign, share, licence, advertise, list or otherwise part with possession of the Residence or any part of it, whether for payment or not, whether for one night or for the Season, and whether directly or through any platform, agency or intermediary. This prohibition is absolute and admits no exception.
Listing the Residence on any accommodation platform, including Airbnb, Booking.com, Vrbo or any successor or equivalent service, is a material breach whether or not a booking results.
Breach of this clause entitles us to terminate this Agreement immediately and without refund, to require all occupants to vacate the same day, to retain the entire Security Deposit, and to recover from the Guest all sums received by the Guest from any such arrangement together with our costs. The Guest acknowledges these consequences are reasonable given the difficulty of quantifying the harm caused to the building, to other guests and to our licences and insurance.
6. Housekeeping Access, Mandatory
A full professional clean is carried out every two weeks throughout the Season and is included in the season charge. Where the weekly housekeeping upgrade has been purchased, the clean is carried out weekly.
Providing access for scheduled housekeeping is a condition of this Agreement, not an optional service. The visit also allows our team to confirm the Residence and its systems are in good order, to identify maintenance needs early, and to check smoke detection and heating.
We will confirm the housekeeping schedule at the start of the Season and give at least 24 hours notice of each visit. The Guest need not be present. Where the Guest denies access, is absent without arrangement, or leaves the Residence in a condition that prevents the clean being carried out, we may reschedule and charge US$75 for the wasted visit.
Refusing access on two or more consecutive scheduled visits is a material breach and entitles us to terminate under the Cancellation clause.
We may also enter the Residence at any time without notice in an emergency, including fire, flood, gas escape, suspected criminal activity, or a genuine concern for the welfare of any person.
7. Condition, Breakages and Damage
An inventory and condition report is prepared before arrival and shared with the Guest. Any discrepancy must be reported within 48 hours of check-in, failing which the report is taken as agreed.
The Guest must keep the Residence in good and clean condition and must report any damage, fault, leak or breakage promptly. Reporting an accidental breakage promptly is expected and will be dealt with reasonably. Concealing damage will not.
The Guest is liable for the cost of repair or replacement of any loss or damage to the Residence, its contents, or the common parts caused by the Guest, any occupant or any visitor, beyond fair wear and tear. Replacement is charged at like-for-like cost plus reasonable labour.
The following are charged at cost with a minimum of US$150 each: damage to flooring, damage to worktops or sanitaryware, damage requiring redecoration, and blocked drainage caused by misuse.
Loss of keys or an access fob is charged at US$100 per item. Where a lock or access system must be re-keyed for security, the full cost is charged.
Smoking anywhere within the Residence or the building carries a charge of US$500 to cover deep cleaning and any lost availability, in addition to the cost of any damage. This applies equally to vaping and to any smoking material.
The Guest must not alter the Residence, redecorate, drill or fix anything to any surface, change any lock, or install any equipment, without our prior written consent.
8. House Standards, a Calm Building
The building is occupied by other guests, many of them on holiday and many of them families. The Guest must not do anything that interferes with their reasonable enjoyment of it. The following apply throughout the Season.
No parties, gatherings or events of any kind are permitted in the Residence or the common parts. The occupancy limits in this Agreement apply at all times, including during the day.
Quiet hours are observed between 22:00 and 08:00. At all other times noise must be kept at a level that is not audible in neighbouring residences. Amplified music, musical instruments and loud gatherings are not permitted at any time.
No pets or animals of any kind may be brought into or kept at the Residence.
Nothing may be thrown or emptied from windows, balconies or terraces, and balconies must not be used for storage. Ski and snowboard equipment is stored in the ski depot provided, not in the Residence, hallways or stairwells.
Candles, open flames, portable heaters, and cooking equipment other than that provided are not permitted. Smoke detectors must not be covered, disabled or removed.
Illegal activity of any kind, including the possession or use of controlled substances, results in immediate termination and will be reported to the authorities.
A first breach of the House Standards results in a written warning. A second breach carries a charge of US$250. A third breach, or any single serious breach such as a party, entitles us to terminate this Agreement immediately without refund and to require all occupants to vacate the same day.
Where a breach results in a complaint that requires us to compensate, relocate or refund another guest, the Guest is liable for that cost in addition to any charge above.
9. Utilities and Fair Use
Heating, electricity, water and Wi-Fi are included in the season charge on a fair-use basis appropriate to normal residential occupancy of the Residence at this altitude and in this climate.
Fair use means the Residence is heated and used sensibly. It does not extend to heating with windows or balcony doors open, running heating at maximum while the Residence is unoccupied for extended periods, or operating equipment not provided by us, including cryptocurrency mining hardware, additional refrigeration, or commercial equipment of any kind.
Where consumption materially exceeds normal use for a comparable residence over any billing period, we will notify the Guest, discuss the cause, and may recharge the excess at documented cost. We will always show the Guest the underlying figures.
The Guest must not interfere with heating controls outside the Residence, the building's plant, or any shared system.
10. Maintenance and Interruption
We will keep the Residence and its systems in good working order and will attend to reported faults promptly, having regard to the location and to conditions on the mountain.
The Guest acknowledges that Gudauri is a high-altitude alpine resort. Interruptions to power, water, internet or road access can occur as a result of weather and are outside our control. Such interruptions do not entitle the Guest to a refund, though we will take reasonable steps to restore service and to assist.
Where the Residence becomes uninhabitable through no fault of the Guest and cannot be made habitable within 72 hours, we will offer a comparable residence where one is available, or a pro-rata refund for the affected period if one is not.
11. Insurance, Liability and Indemnity
The Guest is strongly advised to hold travel and personal insurance covering the Season, including winter sports cover, medical cover and personal liability. We do not insure the Guest's possessions and accept no responsibility for their loss or damage.
Skiing, snowboarding and mountain activity carry inherent risk. The Guest participates in them entirely at their own risk and confirms that all occupants are appropriately insured.
Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, our total liability under this Agreement is limited to the season charge paid.
The Guest indemnifies us against any claim, loss or cost arising from the acts or omissions of the Guest, any occupant or any visitor, including claims by other guests, by the building's owners association, or by any authority.
12. Data and Privacy
Guest identity information is collected because we are required to hold it, and is processed in accordance with our privacy policy. It is retained for the period required by Georgian law and is not used for marketing without separate consent.
The building's common parts may be monitored by CCTV for security. There is no CCTV within any Residence.
13. General
This Agreement, together with the signature block and the inventory, is the entire agreement between the parties in respect of the Season and supersedes any prior discussion, quotation or correspondence.
No variation is effective unless recorded in writing and agreed by both parties. Our failure to enforce any term on any occasion does not waive our right to enforce it subsequently.
If any provision is held unenforceable, the remainder continues in full force.
This Agreement is governed by the laws of Georgia, and the parties submit to the exclusive jurisdiction of the courts of Georgia.
The parties will attempt in good faith to resolve any dispute by discussion before commencing proceedings.
