Property Sales Commission Agreement

1. Parties and Purpose

This Property Sales Commission Agreement (the "Agreement") is entered into between Altimera Collection ("Altimera", "the Agent") and the property owner identified in the signature block or the associated submission ("the Seller").

The Seller instructs Altimera to market and introduce buyers for the property identified in the submission (the "Property"), and Altimera accepts on the terms below.

2. Acceptance on Submission

By submitting the Property for listing and ticking the acceptance box, the Seller confirms they have read this Agreement and agree to its terms taking effect if and when Altimera approves the Property for listing. Altimera may decline any submission at its discretion. The Seller may withdraw the Property at any time before a buyer introduction results in a signed sale agreement.

3. Altimera's Services

Altimera will: (a) prepare a professional listing for the Property, including photography, description and, where relevant, a renovation scope and estimated budget to bring the Property to the Altimera standard; (b) publish the listing on Altimera's website and market it to Altimera's buyer network; (c) handle buyer enquiries, viewings and negotiation support; and (d) where the buyer intends to place the Property under Altimera management, provide projected rental income information.

4. Commission

Altimera's commission is [5]% of the final sale price, payable by the Seller upon completion of a sale to a buyer introduced directly or indirectly by Altimera. No commission is due if no such sale completes. No upfront listing fees apply.

If, within [12] months after this Agreement ends, the Seller completes a sale to a buyer introduced by Altimera during its term, the commission remains payable.

5. Seller's Obligations

The Seller warrants they hold good title to the Property (or the disclosed authority to sell it), that the information and images submitted are accurate and may be used in marketing, and that they will disclose material defects and encumbrances. The Seller will make the Property reasonably available for viewings and respond to offers within a reasonable time.

6. Listing Basis

Unless otherwise agreed in writing, the listing is non-exclusive: the Seller may market the Property themselves or through other agents. Commission is only due on sales to buyers introduced by Altimera, per clause 4.

7. Term and Termination

This Agreement runs until the Property is sold or either party gives [30] days' written notice. Clauses on commission for introduced buyers, and on liability, survive termination.

8. Liability and General

Altimera acts as marketing and introduction agent only; it is not a party to the sale contract, does not provide legal or tax advice, and makes no warranty that a sale will be achieved or at any particular price. Each party's total liability is capped at the commission paid or payable under this Agreement, except liability that cannot lawfully be limited.

This Agreement is governed by the laws of Georgia, with the courts of Georgia having exclusive jurisdiction. Notices may be given by email. This document plus the completed submission form the entire agreement concerning its subject matter.
